‘பீப்’ பாடல் விவகாரத்தில் தனக்கு முன்ஜாமீன் அளிக்கக் கோரி, சென்னை
உயர் நீதிமன்றத் தில் சிம்பு மனு தாக்கல் செய்திருந் தார். நீதிபதி பி.ராஜேந்திரன்
முன்பு இந்த வழக்கு நேற்று விசாரணைக்கு வந்தது.
சிம்பு தரப்பு வழக்கறிஞர் முத்துக் குமாரசாமி தனது வாதத்தில்,
‘‘சிம்பு மீது பதியப்பட்ட அனைத்து பிரிவு களும் ஜாமீனில் வெளிவரக்கூடி யவை. அவர்
தனிப்பட்ட முறையில் ‘பீப்’ போட்டு பாடிய பாடலை பொதுமக்கள் பயன்பாட்டுக்காக
வெளியிடவில்லை. ‘அவர் வெளி நாட்டுக்கு தப்பிவிடுவார். சாட்சி களை கலைப்பார்’ என
அரசு தரப்பு கூறுகிறது. அதுபோன்ற செயல்களில் சிம்பு கண்டிப்பாக ஈடுபடமாட்டார்.
விசாரணைக்கு முழு ஒத்துழைப்பு அளிக்க தயாராக உள்ளார். எனவே அவருக்கு முன்ஜாமீன்
வழங்க வேண்டும்’’ என்றார்.
அரசு தரப்பில் ஆஜரான தலைமை குற்றவியல் வழக்கறிஞர் சண்முக வேலாயுதம்
கூறியதாவது:
‘பீப்’ என்ற ஒலி வரும் இடத்தில் உள்ள விடுபட்ட வார்த்தை என்ன என்பதை,
பாடலைக் கேட்பவர்களே ஊகிக்கச் செய்வதுதான் ‘பீப்’ பாடல். ஆனால், இந்த பாடலில் அந்த
வார்த்தை என்ன என்பதை அப்பட்டமாக எல்லோராலும் கேட்க முடிகிறது. அது பெண்களை
ஆபாசமாக கொச்சைப்படுத்தியுள்ளது. இப்பாடலை எழுதியது, பாடியது, உருவாக்கம் செய்தது
எல்லாமே சிம்புதான். ஆனால் பாடல் எப்படி இணையத்தில் வெளியானது என தனக்கு தெரியாது
என்று அவர் கூறுவதை ஏற்கமுடியாது. இதற்காக அவரிடம் குரல் பதிவு சோதனை நடத்த
வேண்டியது அவசியம். எனவே, அவருக்கு முன்ஜாமீன் அளிக்கக்கூடாது.
இவ்வாறு அவர் கூறினார்.
இருதரப்பு வாதங்களையும் கேட்ட நீதிபதி, ‘‘இந்த வழக்கு கள் அனைத்தும்
ஜாமீனில் வெளிவரக்கூடிய பிரிவுகளில் பதிவு செய்யப்பட்டவை என்பதால், சம்பந்தப்பட்ட
கீழ் நீதிமன்றத்தை சிம்பு தாராளமாக அணுகி ஜாமீன் கோரலாம். அதற்கு எந்த தடையும்
இல்லை. அத்துடன், வரும் 11-ம் தேதி அவர் சென்னை மத்திய குற்றப்பிரிவு போலீஸில்
ஆஜராகி போலீஸ் விசாரணைக்கு ஒத்துழைப்பு வழங்க வேண்டும்’’ என்று உத்தரவிட்டார்.
